Military Codes Of Conduct

Military codes of conduct are the rules which state the rights and wrongs when serving in the military. The laws and regulations that bind soldiers to their line of duty might not be the first sentiments which come to mind when considering the phrase "serve and protect." Indeed it seems as if like us, a great number of the men and women who sign up to Be the Best never consider that it could be the very conditions put in place for their protection which may have the biggest effect on their future.

In fact the code of conduct for a British soldier can be a confusing and often demanding piece of legislation to adhere to and in fact should be given a great deal of care and attention to prevent the problems associated with so called military misconduct.

It is necessary in any case of a broken regulation or even a potential break in the code of conduct on either side, to contact a group who have a specifically designated group of Military Solicitors.

In some cases the decisions of higher ranking officers can be construed themselves as being discriminatory as in the case of Stevenson v Ministry of defense in which allegations of sexual discrimination and victimisation were made against fellow officers. Or in the case of Sidar v The Army Board in which a female military cook who wanted to join the royal marine corp. was accepted, and then in turn rejected based on the fact that she was a woman.

Other cases in which a military court martial is raised against an individual or group of individuals are equally worthy of legal representation by Military Solicitors, as the punishments involved with a court martial are different from those enforced by the English Crown Court. In the case of Schofield v The United Kingdom the accused was alleged to have raped a female junior officer and found guilty with a sentence of 9 years in prison.

In any case, it seems the legislation of the Military Code of Conduct is put in place as a method of protecting those who themselves have vowed to "serve and protect" at all costs. Whether it is used to protect the rights of those who are being discriminated against, protect the military's ideals of an individual's "right to democracy," or even to prosecute an individual for breaking the ethical or moral codes of conduct, the military Laws and regulations should be carefully examined and understood by anyone involved with their repercussions.
